2. Good Faith Use of the Website – User Declarations Regarding Purchases

Every visitor/user is required to use the services provided in good faith and provide true information when placing orders. If malicious use, false orders, or conduct contrary to business ethics is detected, the company reserves the right to refuse or cancel such orders or user requests.

Services are only available to adults (18+) with full legal capacity. By using the services or placing an order, the user confirms that they meet these requirements. The company bears no responsibility if minors or legally incapacitated individuals access or transact through the website.

3. Product Description and Pricing

The online store offers (not limited to) food items, coffee, cooked meals, and packaged drinks (alcoholic or non-alcoholic). All hygiene and safety protocols are followed during preparation, storage, and delivery. Product characteristics are provided by the respective producers, who are solely responsible for the safety, ingredients, labeling, and compliance with relevant laws.

The company endeavors to provide accurate and lawful consumer information.

All product prices include VAT and are listed on www.pitafresca.gr. Prices may change without notice; orders are charged based on the price at the time of order placement.

4. Ordering Process and Payment Methods

Orders can only be placed during the business hours listed on the website. Users may shop as guests or register to create an account.

The ordering process includes:

  1. Filling in personal information (name, email, phone number)
  2. Choosing a payment method
  3. Specifying delivery address and method

A summary screen and confirmation email will follow, showing the order number, products, quantities, prices, and selected payment/delivery options. This email is not a sales contract. The sale is considered final only after order processing.

The company may reject or cancel orders (in whole or part) in cases of force majeure, unavailability, or suspected abuse.

Accepted Payment Methods:

  • Secure online payment through National Bank of Greece
  • Credit card on delivery or pickup

There are no extra charges for deliveries within the stated service areas.

5. Product Shipping & Delivery

Orders are prepared upon receipt and delivered to the specified address. Preparation time depends on order volume and workload.

Delays may occur due to extreme weather, strikes, or other majeure events.

6. Order Cancellation

Buyers may request order cancellation, even after receiving the confirmation email. However, cancellation is not allowed for meals or cooked food once preparation has begun.

7. Right of Withdrawal – Terms and Conditions

You have the right to withdraw from the contract within 14 calendar days without providing any reason.

This applies only to unopened packaged goods in original condition. Cooked meals, coffee or other beverages prepared at our establishment, perishable items, or food items prepared by the store are excluded from the right of withdrawal. To exercise your right, you must notify us clearly (e.g., via email at [email protected]).

You may use the provided withdrawal form, although this is not mandatory.

The right of withdrawal (based on Law 2251/1994) does not apply to:

  • Fully performed services after consumer consent
  • Goods/services with price fluctuations beyond supplier control
  • Customized or personalized goods
  • Perishable goods
  • Sealed goods unsuitable for return once opened (e.g., for hygiene reasons)
  • Goods inseparably mixed with others, after delivery
  • Alcoholic beverages agreed upon but delivered after 30 days

8. Consumer Code of Conduct & Alternative Dispute Resolution (ADR)

Our company adheres to the Consumer Code of Conduct for E-Commerce and complies with both Greek and EU consumer protection laws.

Under EU Directive 2013/11/EU (incorporated into Greek law via Joint Ministerial Decision 70330/2015), you may use Alternative Dispute Resolution (ADR) for any dispute with our e-shop.

Additionally, the company bears no responsibility for any damage that may arise during the use of the website or from the content of third-party websites accessed via links. Users are responsible for ensuring they have appropriate technical means to access the website and are protected from digital threats (e.g., malware, viruses).

The products are delivered in excellent condition. However, in the unlikely event of damage or defect, the buyer should inform the company immediately upon receipt, and appropriate solutions will be proposed.

These terms and any contracts concluded through this online store are governed by Greek law.
